Service Terms

These Service Terms govern mobile repair, diagnostic, maintenance, roadside, fleet, trailer, generator, and equipment services requested from or provided by NYC Mobile Diesel Repair Co.

These terms are intended to explain how service requests, dispatch, diagnostics, repair authorization, parts, payments, cancellations, warranties, field-service limitations, and other service-related matters are handled.

By requesting service, authorizing work, approving an estimate, permitting work to begin, or accepting services from NYC Mobile Diesel Repair Co., you acknowledge and agree to these Service Terms together with any applicable estimate, invoice, repair authorization, Warranty Policy, Cancellation Policy, and other documentation relating to the specific service.

If you are requesting service on behalf of a company, fleet, employer, vehicle owner, contractor, facility, or other organization, you represent that you have authority to request and authorize the applicable work.

The inclusion of a service on our website or in these Terms does not mean that every type of repair can be performed on every vehicle or piece of equipment or at every location.

Actual service capability depends on the equipment, reported problem, accessibility, safety conditions, required tools, parts availability, repair complexity, and other circumstances present at the time of service.

Requesting Service

A customer may request service by telephone, website form, email, or another communication method made available by NYC Mobile Diesel Repair Co.

When requesting service, customers should provide reasonably accurate information about:

  • Customer or company name
  • Contact telephone number
  • Service location
  • Vehicle or equipment type
  • Unit or fleet number where applicable
  • Reported problem
  • Whether the engine starts or cranks
  • Whether the equipment can move
  • Warning lights or fault messages
  • Visible leaks or damage
  • Whether a trailer is attached
  • Access restrictions
  • Known safety concerns
  • Other information relevant to the service request

Information provided during the initial request helps us understand the reported condition but does not constitute a diagnosis.

Customers should notify us if the location, equipment condition, access situation, or requested work changes before service begins.

A Service Request Does Not Guarantee Dispatch

Submitting a service request does not guarantee that a technician will be dispatched or that a particular service will be accepted.

Service availability may depend on:

  • Current workload
  • Technician availability
  • Service location
  • Distance
  • Traffic
  • Weather
  • Roadside conditions
  • Equipment type
  • Nature of the repair
  • Safety considerations
  • Parts availability
  • Access to the equipment
  • Other operational circumstances

A service call is not confirmed merely because a voicemail, website form, email, text message, or other inquiry has been submitted.

Customers should rely on direct confirmation from NYC Mobile Diesel Repair Co. regarding accepted service requests.

No Guaranteed Arrival or Completion Time

We may provide estimated arrival, service, diagnostic, or completion information when reasonably possible.

Any such estimate is an estimate only unless expressly stated otherwise in writing.

Arrival or completion may be affected by circumstances including:

  • Traffic congestion
  • Road closures
  • Weather
  • Earlier service calls
  • Emergency conditions
  • Equipment accessibility
  • Diagnostic complexity
  • Parts availability
  • Safety concerns
  • Customer delays
  • Site restrictions
  • Conditions discovered after work begins

We do not guarantee a particular arrival time, repair duration, or return-to-service time unless a specific written agreement expressly provides otherwise.

Mobile Service Depends on Location and Repair Feasibility

Our service model is designed to perform appropriate diagnostics, maintenance, and repairs at the location of the truck, trailer, generator, fleet vehicle, or other supported equipment.

However, mobile service does not mean that every repair can safely or effectively be completed in the field.

Some work may require:

  • Towing or recovery
  • Shop facilities
  • Heavy lifting equipment
  • Extensive disassembly
  • Machining
  • Specialized testing equipment
  • Controlled environmental conditions
  • Additional personnel
  • Parts not available at the service location
  • Equipment relocation
  • Other resources not practical for mobile service

If the required work is not appropriate for field completion, we may recommend another service approach.

The fact that a technician has arrived at the equipment does not guarantee that the complete repair can be performed at that location.

Roadside and Work-Site Safety

Safe working conditions are required before and during service.

We may decline, delay, suspend, relocate, or discontinue work when conditions create an unreasonable risk to personnel, customers, equipment, traffic, property, or other persons.

Examples may include:

  • Unsafe highway positioning
  • Insufficient shoulder space
  • Moving traffic exposure
  • Unstable equipment
  • Fire or explosion hazards
  • Fuel or chemical hazards
  • Severe weather
  • Flooding
  • Poor lighting
  • Unsafe work surfaces
  • Active construction hazards
  • Restricted-access areas
  • Dangerous cargo conditions
  • Threatening behavior
  • Unsafe electrical conditions
  • Other hazards that prevent reasonable field work

Customers should not attempt to move, lift, disconnect, energize, or operate equipment in a way that creates additional risk unless instructed by a qualified person and legally permitted to do so.

Safety takes priority over completing a repair at a particular location.

Customer Responsibility for Site Access

The customer is responsible for providing lawful and reasonably safe access to the vehicle or equipment requiring service.

This may include ensuring access to:

  • Fleet yards
  • Parking lots
  • Job sites
  • Loading areas
  • Facilities
  • Terminals
  • Gated properties
  • Construction sites
  • Equipment storage areas
  • Docks or marine-access areas where relevant
  • Other controlled locations

If entry requires security clearance, gate access, keys, authorization, escorts, permits, or coordination with a property manager, the customer is responsible for arranging that access unless otherwise agreed.

Delays caused by inaccessible equipment or unavailable authorization may affect service timing and applicable charges.

Customer Authorization to Request Service

The person requesting service represents that they have authority to request evaluation or work on the applicable vehicle, trailer, generator, machine, or other property.

Customers may include:

  • Owners
  • Drivers
  • Fleet managers
  • Dispatchers
  • Employees
  • Contractors
  • Facility representatives
  • Rental companies
  • Authorized agents

If approval from another person or company is required before work may proceed, the customer is responsible for obtaining that authorization.

We may request reasonable confirmation of authority before beginning or continuing work.

Diagnostics and Troubleshooting

Diagnostic service is a process of gathering evidence to identify or narrow down the cause of a reported problem.

Depending on the equipment and complaint, diagnostic work may involve:

  • Visual inspection
  • Fault-code review
  • Electrical testing
  • Voltage or resistance measurements
  • Battery and charging-system checks
  • Starting-system checks
  • Fuel-system testing
  • Sensor evaluation
  • Live operating data
  • Mechanical inspection
  • Temperature observations
  • Pressure checks
  • Wiring inspection
  • Operational testing
  • Other appropriate diagnostic procedures

A diagnostic service does not necessarily result in an immediate repair. The outcome may identify:

  • A confirmed repair
  • A likely failed system
  • Additional testing requirements
  • Multiple contributing problems
  • A need for parts
  • A need for specialized service
  • A need for towing or relocation
  • A condition outside the scope of the original request

Diagnostic conclusions are based on the equipment condition and evidence available at the time of evaluation.

Fault Codes Do Not Automatically Authorize Parts Replacement

Fault codes, warning lights, and electronic messages can provide useful diagnostic information, but they do not necessarily prove that the component named in a code description has failed.

Replacement decisions may require additional testing.

Customers should not assume that:

  • A code identifies the exact failed part
  • Clearing a code fixes the underlying problem
  • A warning light has only one possible cause
  • Replacing the first component associated with a code guarantees resolution

When diagnostic work is authorized, the purpose is to determine the appropriate repair direction based on available evidence.

Diagnostic Work Is Separate From Repair Work

Unless specifically included in the agreed service scope, authorization to diagnose a problem does not automatically authorize all repairs identified during diagnosis.

Similarly, authorization for one repair does not automatically authorize unrelated additional repairs.

If additional work is recommended after diagnosis, we may seek further approval before proceeding.

Applicable diagnostic, service-call, travel, labor, or other charges may still be due even if the customer chooses not to proceed with a recommended repair, where those charges were disclosed or otherwise agreed to.

Estimates and Service Recommendations

An estimate may be provided based on the information available at the time it is prepared.

Estimates may consider:

  • Expected labor
  • Identified parts
  • Diagnostic findings
  • Known service requirements
  • Equipment type
  • Service location
  • Expected repair complexity

An estimate is not necessarily a guarantee that no additional issue will be discovered.

Commercial diesel vehicles and equipment can have hidden, interconnected, intermittent, or pre-existing problems that become apparent only after inspection, testing, disassembly, or operation.

If additional work materially changes the expected repair scope or cost, we may request additional authorization before proceeding.

Repair Authorization

The customer is responsible for reviewing and approving the requested work.

Authorization may be provided through a method reasonably used in the transaction, including:

  • Written approval
  • Electronic approval
  • Text-message approval
  • Email
  • Telephone authorization
  • Signed documentation
  • Another recorded or documented communication

By authorizing repair work, the customer agrees that NYC Mobile Diesel Repair Co. may perform the approved work and incur labor and parts costs within the authorized scope.

The customer should ask questions about the proposed repair before providing authorization if clarification is needed.

Changes to the Authorized Repair Scope

Conditions discovered during service may make the original repair plan incomplete or impractical.

Examples include:

  • Additional damaged wiring
  • Corroded connections
  • Broken fasteners
  • Hidden leaks
  • Contaminated fluids
  • Damaged related components
  • Multiple fault conditions
  • Previously modified wiring
  • Aftermarket components
  • Missing parts
  • Prior incomplete repairs
  • Structural damage
  • Additional brake or suspension wear

When additional work is recommended, we may provide updated information and request further authorization.

If the customer declines additional work, we may complete only the authorized portion where doing so is reasonable and safe.

Pre-Existing Conditions

Commercial vehicles and equipment may have conditions that existed before our service began.

Examples include:

  • Existing leaks
  • Corrosion
  • Damaged connectors
  • Worn components
  • Prior repairs
  • Modified wiring
  • Missing fasteners
  • Previous fault codes
  • Contamination
  • Structural damage
  • Poor maintenance
  • Aftermarket modifications
  • Other unresolved failures

Our work on one system does not mean we have inspected or accepted responsibility for every other system on the vehicle or equipment.

A repaired component may also interact with another pre-existing condition that remains unresolved.

Additional Problems Discovered During Service

Finding a second problem does not necessarily mean that the original diagnosis or repair was incorrect.

Commercial trucks, diesel engines, trailers, generators, and equipment can have multiple faults at the same time.

For example, correcting a starting problem may reveal a separate charging problem, fuel concern, warning condition, or engine-performance issue that could not be evaluated fully while the equipment was disabled.

Additional problems will be addressed according to their own diagnostic and repair requirements.

Parts Availability

Repair completion may depend on the availability of suitable replacement parts.

Parts may be:

  • In stock
  • Locally available
  • Special order
  • Backordered
  • Discontinued
  • Temporarily unavailable
  • Subject to supplier delivery schedules

A technician’s arrival does not guarantee that every required part will be immediately available.

Parts availability may affect repair timing, return visits, estimates, or whether a repair can be completed at the original service location.

Replacement Parts

Replacement components will be selected based on suitability for the repair, availability, customer authorization, and other relevant service considerations.

Unless expressly stated in writing, website content should not be interpreted as a guarantee that every replacement component will be:

  • Original equipment manufacturer equipment
  • Dealer-supplied
  • A particular brand
  • New rather than remanufactured
  • Covered by a specific manufacturer warranty

Any material part choice relevant to the repair may be communicated through the applicable estimate, authorization, or service discussion.

Customer-Supplied Parts

Customer-supplied parts may be accepted or declined at our discretion depending on the repair and circumstances.

If customer-supplied parts are accepted:

  • The customer is responsible for obtaining the correct part unless otherwise agreed.
  • Additional labor may result if the supplied component does not fit or function correctly.
  • Delays caused by incorrect or defective customer-supplied parts are not part of the original repair time.
  • Manufacturer or seller warranty issues involving the supplied part generally remain between the customer and the part supplier unless otherwise agreed.

Warranty coverage for labor involving customer-supplied parts, if any, is governed by the applicable Warranty Policy or specific written service terms.

Special-Order and Non-Returnable Parts

Certain repairs may require special-order, custom, electronic, programmed, non-returnable, or supplier-restricted parts.

Where applicable, customers may be responsible for charges associated with authorized special-order components even if the service is later canceled or the customer decides not to complete the repair.

Any deposit, restocking, non-returnable part, or cancellation requirements should be communicated as applicable to the particular transaction.

The separate Cancellation Policy may also apply.

Removed and Replaced Parts

Disposition of removed parts may depend on the type of component, supplier requirements, core charges, warranty procedures, environmental considerations, and applicable law.

Certain replacement parts may require the old component to be returned as a core.

If a customer wants to retain a removed part, the customer should make that request before the repair is completed. Retention may not be possible where the component must be returned to a supplier, manufacturer, warranty provider, or other party.

Fluids, Filters, Lubricants, and Maintenance Materials

Maintenance and repair work may involve oils, filters, coolant, lubricants, and other service materials.

The required material may depend on:

  • Equipment specifications
  • Existing fluid condition
  • Operating environment
  • Service history
  • Manufacturer requirements
  • Availability
  • Type of maintenance being performed

Routine service does not automatically include every fluid or filter on the equipment unless the applicable work scope states otherwise.

Operational Testing After Service

Certain repairs may require testing after work is completed.

Testing may include:

  • Starting the engine
  • Idling
  • Applying electrical loads
  • Checking charging output
  • Operating controls
  • Testing brake application or release
  • Monitoring engine data
  • Checking for leaks
  • Performing regeneration-related procedures
  • Moving equipment a limited distance where safe, lawful, and appropriate
  • Other reasonable verification procedures

The purpose of testing is to evaluate the serviced system.

Successful testing at the time of repair does not guarantee that no unrelated or future problem will occur.

Permission to Operate or Move Equipment for Testing

Where operational testing reasonably requires the equipment to be started, operated, or moved, the customer authorizes such testing within the scope reasonably necessary to evaluate the approved service, provided that conditions allow it to be done safely and lawfully.

Customers should disclose any condition that would make operation unsafe, including:

  • Brake concerns
  • Steering concerns
  • Unsecured cargo
  • Known drivetrain problems
  • Unsafe tires
  • Legal operating restrictions
  • Missing permits
  • Vehicle immobilization orders
  • Other hazards

We may decline operational testing when conditions do not permit it safely or lawfully.

Customer Responsibilities During Service

Customers are responsible for cooperating reasonably with the service process.

Responsibilities may include:

  • Providing accurate equipment information
  • Providing the correct location
  • Maintaining reachable contact information
  • Providing lawful equipment access
  • Providing keys when necessary
  • Obtaining company or fleet authorization
  • Disclosing known safety hazards
  • Disclosing relevant prior repairs
  • Informing us of known modifications
  • Securing cargo and personal property
  • Keeping unauthorized persons away from the work area
  • Following reasonable safety instructions
  • Reviewing repair recommendations
  • Providing timely authorization decisions
  • Paying applicable authorized charges

Failure to provide necessary access or information may prevent or delay completion of the requested service.

Customer Property, Cargo, and Personal Items

Customers should secure valuables, tools, cargo, documents, electronics, and other personal or business property before service begins.

Unless directly involved in the approved repair, we do not assume responsibility for inventorying or safeguarding the contents of trucks, trailers, equipment compartments, storage areas, or other customer property.

Customers should disclose valuable, hazardous, restricted, temperature-sensitive, or otherwise unusual cargo when it could affect service safety or access.

Hazardous Materials and Unsafe Conditions

Customers must disclose known hazardous conditions that could reasonably affect service personnel.

These may include:

  • Fuel spills
  • Chemical leaks
  • Hazardous cargo
  • Flammable materials
  • High-voltage systems
  • Pressurized systems
  • Biohazards
  • Unstable loads
  • Fire damage
  • Contaminated work areas
  • Other dangerous substances or conditions

We may refuse or stop work when an undisclosed hazard or unsafe condition is discovered.

Aftertreatment and Emissions-Related Service

DPF, DEF, SCR, regeneration, sensor, and other aftertreatment services are intended to diagnose or repair supported system faults.

Service does not constitute a guarantee that:

  • A vehicle will pass a governmental inspection
  • A vehicle will meet every regulatory requirement
  • A particular fault will not recur
  • Another emissions-system problem does not exist
  • The vehicle will avoid future derate conditions

We do not represent that every aftertreatment service constitutes an official regulatory inspection, certification, or compliance determination unless expressly stated otherwise in writing.

Brake and Safety-Critical Repairs

Brake, suspension, steering-related, electrical, wheel-end, and other safety-critical conditions may require additional inspection or repair before equipment should return to normal operation.

If we identify a condition that appears unsafe, we may recommend that the vehicle or equipment remain out of operation until the condition is addressed.

A customer’s decision to operate equipment after declining recommended safety-related work is the customer’s responsibility, subject to applicable law.

Repairs That Require Towing or Relocation

Mobile diagnosis may determine that the equipment needs to be moved to another facility.

This can occur when the repair requires:

  • Extensive teardown
  • Major engine work
  • Transmission removal
  • Machining
  • Heavy lifting
  • Structural repair
  • Specialized facilities
  • Recovery equipment
  • Controlled environmental conditions
  • Other shop-dependent work

A recommendation for towing or relocation does not mean that the initial mobile service was unnecessary. Determining that field repair is not appropriate may itself be an important diagnostic outcome.

Unless separately agreed, towing, recovery, transportation, or third-party facility charges are not automatically included in the mobile service.

Third-Party Services

A repair may sometimes require a service, part, facility, tow provider, supplier, manufacturer, dealer, or specialist outside the scope of the work being performed by NYC Mobile Diesel Repair Co.

Any third-party service is subject to its own availability, pricing, policies, and terms unless expressly included in our written agreement.

We do not control independent third parties merely because their service may be suggested or used in connection with a repair.

Delays Outside Our Reasonable Control

Circumstances outside our reasonable control may delay service.

Examples may include:

  • Traffic
  • Road closures
  • Weather
  • Public emergencies
  • Supplier delays
  • Parts shortages
  • Restricted site access
  • Security procedures
  • Police activity
  • Towing delays
  • Customer authorization delays
  • Equipment location changes
  • Utility outages
  • Telecommunications failures
  • Other circumstances that could not reasonably be avoided

We will not treat an estimated time as a guaranteed deadline unless expressly agreed in writing.

Charges and Payment Terms

Charges for a service may include, where applicable and disclosed:

  • Diagnostic labor
  • Repair labor
  • Service-call charges
  • Travel-related charges
  • Parts
  • Materials
  • Fluids
  • Filters
  • Special-order components
  • Additional authorized work
  • Applicable taxes
  • Other agreed service expenses

The actual amount due will be governed by the estimate, authorization, invoice, or other service documentation applicable to the job.

Payment is due according to the terms communicated for the specific service.

Nothing on the website should be interpreted as a promise of free diagnostics, free estimates, no service-call fee, financing, fleet credit, or a particular payment method unless expressly confirmed for the transaction.

Taxes and Other Required Charges

Applicable sales tax, fees, or other legally required charges may be added where required by law.

The customer is responsible for amounts properly due in connection with authorized service unless a separate written agreement states otherwise.

Fleet and Commercial Accounts

Businesses requesting service for multiple units may have different billing, authorization, or scheduling requirements.

No fleet-credit arrangement, deferred billing, account status, purchase-order arrangement, or other commercial payment term exists unless specifically approved.

Individual service requests remain subject to the applicable estimate, invoice, authorization, and these Service Terms unless a separate written fleet agreement controls.

Declined Repairs

A customer may choose not to authorize a recommended repair.

If repair is declined:

  • Authorized diagnostic work may still be payable.
  • Previously performed labor remains payable.
  • Authorized parts already obtained may remain subject to applicable charges.
  • We may document the declined recommendation.
  • We do not guarantee the safety or continued operation of equipment with an unresolved problem.

Customers should consider the mechanical and safety implications before operating equipment after declining recommended work.

Incomplete Repairs

A service may remain incomplete because of:

  • Parts availability
  • Customer refusal of additional work
  • Unsafe conditions
  • Site-access limitations
  • Need for shop equipment
  • Discovery of additional faults
  • Need for towing
  • Supplier delays
  • Lack of authorization
  • Other circumstances

Where partial work has been completed, charges may apply for the labor, diagnostics, parts, and other services already authorized and performed.

Service Records and Documentation

We may maintain reasonable service records relating to:

  • Customer contact information
  • Equipment
  • Reported symptoms
  • Diagnostic findings
  • Work performed
  • Parts
  • Authorizations
  • Invoices
  • Communications
  • Follow-up issues

We may also document relevant equipment conditions through notes, fault information, measurements, or photographs where reasonably appropriate to the service.

Personal information contained in service records is handled according to our Privacy Policy.

Photographs and Condition Documentation

During diagnostics or repair, we may photograph or otherwise document components, fault conditions, damage, leaks, wiring, replaced parts, or other service-relevant conditions for purposes such as:

  • Repair documentation
  • Customer communication
  • Service records
  • Warranty review
  • Dispute resolution

Service documentation is not automatically intended for advertising or public use.

Handle any separate marketing use of identifiable customer information according to applicable privacy and consent requirements.

Cancellation and Rescheduling

Customers who need to cancel or reschedule a service call should contact NYC Mobile Diesel Repair Co. as soon as reasonably possible.

Cancellation may be treated differently depending on whether:

  • Dispatch has occurred
  • Travel has begun
  • A technician has arrived
  • Diagnostic work has started
  • Parts have been ordered
  • Special-order parts have been obtained
  • Labor has already been performed

Our separate Cancellation Policy and any transaction-specific agreement govern applicable cancellation, rescheduling, dispatch, parts, or no-show terms.

No-Shows and Inaccessible Equipment

A service call may be treated as inaccessible or unsuccessful when a technician cannot reasonably reach or begin work because of circumstances such as:

  • Incorrect service address
  • Equipment moved without notice
  • Locked property
  • Missing keys
  • No authorized representative
  • Security denial
  • Inaccessible yard
  • Unsafe location
  • Customer not responding
  • Equipment unavailable at the agreed location

Applicable charges may still apply where dispatch, travel, or other authorized service activity has already occurred.

Warranty Coverage

Eligible repair work may be covered only to the extent expressly stated in our Warranty Policy, applicable invoice, or other written service documentation.

Warranty coverage, if applicable, may depend on:

  • The specific repair performed
  • Parts used
  • The cause of the later complaint
  • Whether the issue is related to the original repair
  • Customer compliance with warranty requirements
  • Inspection of the claimed problem
  • Applicable exclusions

Service on one component does not create a warranty covering the entire vehicle, engine, trailer, generator, or machine.

No specific warranty duration should be assumed unless it is expressly stated in applicable warranty documentation.

Warranty Claims Require Evaluation

A recurring symptom after service does not automatically establish that the original repair failed.

A similar symptom can have a different cause.

Warranty evaluation may require us to inspect the equipment and determine whether the current problem:

  • Involves the repaired component
  • Results from artistry
  • Involves a warranted part
  • Is unrelated to the prior repair
  • Results from another failed component
  • Results from misuse or external damage
  • Falls outside applicable warranty coverage

Customers should follow the claim procedure described in the Warranty Policy.

No Guarantee Against Future Breakdowns

Repairing a current failure does not guarantee that another component will not fail later.

Commercial diesel vehicles and equipment operate through many interconnected systems that wear, age, and fail independently.

Unless expressly included in the approved work scope, service does not constitute a complete inspection or warranty of:

  • The entire engine
  • Complete electrical system
  • Complete fuel system
  • Complete brake system
  • Complete trailer
  • Complete generator
  • Complete machine
  • Every related component

We evaluate future failures based on their condition and cause.

Refusal or Discontinuation of Service

We may decline or discontinue service when reasonably necessary.

Reasons may include:

  • Unsafe working conditions
  • Threatening or abusive behavior
  • Illegal requests
  • Lack of authority to approve service
  • Fraud or suspected fraud
  • Inaccessible equipment
  • Misrepresentation of equipment condition
  • Work outside our service capability
  • Lack of required parts or tools
  • Conditions requiring a specialized facility
  • Nonpayment of amounts properly due
  • Other circumstances that make continued service unreasonable or unsafe

Ending a service call does not eliminate payment obligations for authorized work already performed.

Customer Conduct

Customers, drivers, employees, contractors, and site representatives must not interfere with work in a manner that creates a safety risk.

Threatening, abusive, violent, discriminatory, or dangerous conduct may result in immediate suspension or termination of service.

Customers should keep unnecessary personnel away from active repair areas and comply with reasonable safety instructions.

Commercial Downtime and Operational Decisions

We understand that disabled commercial equipment can affect routes, deliveries, fleets, jobs, events, and business operations.

However, service requests do not guarantee:

  • A particular return-to-service time
  • Preservation of a delivery schedule
  • Avoidance of towing
  • Avoidance of missed work
  • Avoidance of cargo delay
  • Continuous fleet availability
  • Continuous generator operation
  • Prevention of future breakdowns

Customers remain responsible for operational decisions relating to dispatch, cargo, staffing, alternative vehicles, substitute equipment, scheduling, towing, rental equipment, or other business-continuity measures.

Limitation of Liability

To the fullest extent permitted by applicable law, any liability arising from services provided by NYC Mobile Diesel Repair Co. will be subject to applicable law and the specific facts of the transaction.

To the extent legally permitted, we will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from matters outside the authorized service scope, including losses associated with:

  • Lost business
  • Lost profits
  • Missed deliveries
  • Cargo delays
  • Rental expenses
  • Substitute equipment
  • Event interruption
  • Downtime unrelated to negligent service
  • Unrelated component failures

Nothing in these Service Terms excludes or limits liability that applicable law does not permit us to exclude or limit.

Review this section with the company’s actual insurance, business structure, and governing law before publication.

Indemnification

To the extent permitted by applicable law, the customer agrees to be responsible for claims, damages, losses, or reasonable expenses arising from the customer’s:

  • Fraudulent service request
  • Lack of authority to request work
  • Material misrepresentation
  • Unlawful conduct
  • Undisclosed hazardous condition
  • Violation of these Service Terms
  • Interference with safe repair procedures

This provision does not impose liability beyond what applicable law permits.

Relationship to the Terms of Use

The website Terms of Use govern access to and use of our website.

These Service Terms govern actual service requests and transactions.

If website information conflicts with specific written service documentation regarding an accepted repair, the applicable estimate, authorization, invoice, warranty terms, or Service Terms will generally control the service transaction.

Relationship to the Privacy Policy

We handle personal information collected in connection with service requests, dispatch, invoices, communications, and related business activity according to our Privacy Policy.

The Privacy Policy addresses matters including:

  • Contact information
  • Service-request information
  • Location information
  • Communications
  • Website information
  • SMS communications
  • Information sharing
  • Retention
  • Security
  • Privacy rights

Relationship to the Warranty Policy

Our Warranty Policy governs warranty eligibility, exclusions, claims, inspection requirements, and available remedies for covered work.

These Service Terms should not be interpreted as creating a warranty beyond the coverage expressly provided in applicable warranty documentation.

Relationship to the Cancellation Policy

Our Cancellation Policy governs service-call cancellations, rescheduling, dispatch-related cancellations, no-shows, inaccessible equipment, ordered parts, and other cancellation-related matters.

Where the Cancellation Policy specifically addresses an issue, that policy applies to the cancellation or rescheduling question.

Governing Law and Dispute Resolution

The governing-law, venue, and dispute-resolution provisions for these Service Terms should reflect the actual legal entity operating NYC Mobile Diesel Repair Co. and the jurisdiction applicable to its business operations.

Before publication, the company should confirm:

  • Full legal entity name
  • State of formation
  • Principal business jurisdiction
  • Governing law
  • Appropriate venue
  • Whether mediation, arbitration, or court proceedings apply
  • Any legally required consumer or commercial notices

This section should be finalized with qualified legal counsel rather than inferred solely from the business name or service territory.

Severability

If a provision of these Service Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the extent permitted by applicable law.

Where legally appropriate, an invalid provision may be interpreted or limited in a manner that most closely reflects its intended lawful purpose.

No Waiver

Failure to enforce a provision of these Service Terms in one situation does not permanently waive our right to enforce that provision or another provision in the future.

Any waiver is effective only to the extent recognized by applicable law.

Changes to These Service Terms

We may update these Service Terms to reflect changes in:

  • Services
  • Business practices
  • Technology
  • Dispatch procedures
  • Payment processes
  • Policies
  • Applicable legal requirements
  • Other operational circumstances

When we update these Terms, we will post the revised version and change the “Last Updated” date.

Service transactions already subject to separate written terms may continue to be governed by the version applicable to that transaction where required by law or agreement.

Entire Service Agreement

These Service Terms, together with applicable estimates, repair authorizations, invoices, the Warranty Policy, the Cancellation Policy, and any other transaction-specific written agreement, govern the applicable service.

If a transaction-specific written agreement contains terms that expressly differ from these general Service Terms, the more specific written terms may control that issue to the extent permitted by law.
